周二在一个车行买车，用debit card下了 500元定金。签字的时候没有注意到有一行小字：The purchaser agrees that if he/she does not accept delivery of the motor vehicule in accordance with the term hereof, this agreement may be cancelled by the dealer, and all monies paid as depoist will be retained by the dealer as liquidation damages and not as a penalty.

现在由于个人原因，肯定无法买这个车了。请问各位达人我能否拿回定金？听说在魁省不退买车定金是违法的，请问有人知道相关的法律条文么？:confused:

你只能看是否可以和他们谈谈，要回定金，不过他们给你的可能性很小。不过，他们可能会给你一个500得折扣券，你或者你的朋友可以买车时用。
不知道你是听谁说的“魁省不退定金是非法的“，据我所至，恰恰相反，是合法的。

254. Any sum of money received by a merchant from a consumer before the making of a contract shall be transferred in trust. The merchant is the trustee of the sum, and must deposit it in a trust account until the sum is repaid to the consumer on demand or until the contract is made.

按照这个说法，商家或者完成合同，或者把定金退给客户，否则必须存放在一个trust account中，不能作为自己的收入。不知道理解是否正确。

那商家就选择完成合同．

主要看谁违约．如果买方违约，然后商家又把定金退给你，那定金就没任何意义哪．
