卫生间天花板漏水

卫生间天花板漏水已经有一个月了,房东派人来看了几次,没有采取任何行动,也不说个解决方案。现在时不时的还会漏水。请教如何和房东交涉,采取什么方法好。谢谢!

For this leaking problem in your bathroom, you have two options:



1. Urge your landlord to do the repairs in a timely manner immediately. The landlord is required by law to duly perform such obligation, otherwise you can file your complaint to the court or housing committee.
Civil Code of Quebec


1864. The lessor is bound, during the term of the lease, to make all necessary repairs to the leased property other than lesser maintenance repairs, which are assumed by the lessee unless they result from normal aging of the property or superior force.

2. You can do the reparis on your own or use a plumber etc, if this leaking has materially affected your daily life and it is urgent to make repairs. Then you retain the receipt of such repair fee. At the end of the month, you can deduct such amount of money from your rent to your landlord.
Civil Code of Quebec


1868. Where the lessee has attempted to inform the lessor, or has informed him but the lessor has not acted in due course, the lessee may undertake repairs or incur expenses, even without the authorization of the court, provided they are urgent and necessary to ensure the preservation or enjoyment of the leased property. The lessor may intervene at any time, however, to pursue the work.

The lessee is entitled to reimbursement of the reasonable expenses he incurred for that purpose; he may, if necessary, withhold the amount of such expenses from his rent.

刚才看到lz的遭遇和我的一样,只是我的卫生间天花板已经漏过6、7次了,房东派人来检查了几次,都查不出原因,因为漏水通常发生在半夜,白天来时就没 事。我已经发了挂号信给房东,至今还没有回音,期限一到,我准备将支票存到Rental Board,何时修好,何时再付。问题是如果修好后,还可以以此为理由要求降低房租或是搬出吗?请楼上的xd抽空解答一下,谢谢。

Is it possible that it is because your neighbour upstairs usually takes a bath before going to sleep and gets lots of water outside his/her bathtub?

我的也是啊,有人来看了,就是不见修,郁闷。准备写信给房东再不修好就不付房租了。

不付房租是不可能的,只有法官同意你才可以这么做。劝你不要随意寄信,会多花很多钱的(挂号信一封都要7刀多)。先去rental board,问清楚了决定告房东了,立了case会有一个文件,到时候一并寄给房东。

据说情况是这样。我已经到rental board立案,很遗憾,现在听说最快都要等七八个月才能上庭,不知道到时候我是否还住在这儿。
