According to Regie Du Logement, no need to discuss with the landlord... it is the right of the tenant to sublet the apt. However the tenant must notice the landlord for the sublease in writing, either in register mail or with the signature of the landlord if delivery in person. The landlord must reply within 15 days. if there is not any serious reason, such as a record of late rent payment, the landlord could not refuse the sublease. After 15 days, sublease is valid automatically if no response from the landlord. Most important, if the landlord refuse the sublease without serious reason, u could go to the Regie Du Logement to open a file to claim the sublease is valid.
Note: if you have signed a lease that has a claim of refusing sublease (some comanies put a claim of refusing sublease in the comment of the lease), then u have to discuss with the landlord. |
