if it is legal for you to work here,you can go to court to sue him.that is not a problem.
if you are illegal,that is not a problem also,you can tell the employer,if he don't pay your salary,you will sue him on the court.because,it is illegal for him to hire a person without working permission.

so, whatever your status is ,you can ask money from the employer.
