2016年主要居所出售新规

2016年10月3日，联邦税局发布主要居所（principal residence）出售新规。新规定要求，2016后1月1日之后个人出售主要居所需要在报税时报告房产基本信息。

为适应新规，Schedule 3 将作出相应修改，增加主要居所购置年代，出售价和房产描述等信息。

对于房产不满足所有年度都是主要居住的情况，主要居住指定表格T2091/T1255仍适用。

新规也适用于视同销售（deemed disposition）情况。视同销售是指房产赠与、损毁、用途改变（如自住转为出租、全部/部分用于生意）等情况。

对于忘记指定主要居住而希望作出调整的申报，联邦税局可能根据纳税人要求作出调整。但可能会作出一定罚款。罚款额自规定申报截止日算起，每月$100，最高$8000。需要注意的是，调整要求在满足一定的条件下才予以考虑。

看过您几个帖子，觉得您对这类法例的理解比较深入。
请问：Duplex 一半自住，一半出租。只要没超过50%出租，平时租金有报税，在新政策下是否也不用付 Capital gain, 只是报税时报告一下卖价及购买年代等等信息？

Capital Gain是指出售/视同出售资产而产生的收益，在税法体系的设置中，一般原则里规定，一切资产的出售都是应税收入。其中又有一些减免特列情况的规定, 主要居所收益免税是其中的一个情况。

主要居所部分出租后，住所销售的减免规定在T4036和S1-F3-C2里规定比较清楚。符合免税的条件描述为：

   "It is the CRA's practice not to apply the deemed disposition rule, but rather to consider that the entire property retains its nature as a principal residence, where all of the following conditions are met:

         a) the income-producing use is ancillary to the main use of the property as a residence;
         b) there is no structural change to the property; and
         c) no CCA is claimed on the property."------2.59_S1-F3-C2

这里所说的是在自己的主要居所内。这样，主要居所的定义就是成为这个免税规定的重要组成部分。

主要居所是指一个独立的居住空间，判断的依据包括独立出口、独立的卫生间等标准。而Deplex一般被定义两个两个独立单元。

T4036 也对主要居所作出明确定义：“Your principal residence can be any of the following types
of housing units:
......
an apartment in a building such as a duplex or triplex;
......“ -----T4036

再请问：Duplex 楼上的租客走后，因为房东讨厌噪音，二楼不再出租，直到卖房。这情形是否另有规定?

From CRA IT 120:
The following are the types of property that can qualify as a “principal residence”:
• a housing unit, which includes:
− a house,
− an apartment or unit in a duplex, apartment building
or condominium,
.
In the most case, the principal residence exemption can apply to only one of a duplex unit.

Taking CCA is just ONE factor: the main issue is the overall size of the rented dwelling vs. the owner-occupied dwelling. With a duplex, the rented portion will not be considered "small" in relation to the owner-occupied portion.
