I immigrated and move to Montreal last July.  Has no job yet and took some McGill special courses and public examination.  Can anyone let me know if I can claim for the tution or examination fees tax credit?

Yes, you can. Part-time student 120/m, Full-time 400/m, eg, 400*8=3200 for an academic year. If you don't have income, you don't need to pay the tax. However, you can claim the tax credits which can carry forward to the following years.

You can also transfer the tax credit to your spouse if he/she has income. The transferable amount is limited to $5000/year.See ITA 118.6; ITA 118.61

No, in the federal income tax return of 2004, the limitation of $5000/year to either the transferable or deductable amount has been eliminated in this year.
