We’ve all been tempted by incredible deals and savings that can be found from online shopping. With the success of eBay, Amazon, Play to name but a few online retailers that are delivering great value to their valuable online customer base.
But there are those deals that often seem too good to be true, the penny auctions, boasting “95% Savings”, where you can purchase the latest techno-gadgetry at budget prices! Or can you?
Here is a quick run down of how it supposed to work with these sites:
Step 1, you sign up and purchase bids;
Step 2, you find the product you want and place your bid- Note: each bid increases the product price by 1 penny (hence ‘penny auction’) and in most cases adds a set amount of time to the auction (normally 15 seconds to 1 minute);
Step 3, the timer on the auction runs down to zero
Step 4, you pay for your item, it is shipped and you are one happy bunny with your incredible 95% saving!
Recall the old phrase “if it seems too good to be true, it probably is”, although there are some penny auction sites that are offering this legitimately cheap deal on various products, there are others who are quite simply trying to deceive consumers from the start. One such enterprise is a “penny auction” site called Ziinga.com.
Ziinga, owned by Flamingo Intervest – who recently became a subsidiary of Nio Security Inc. (Now Nio Inc.) – appear at first glance as a legitimate penny auction site much like Madbid, Bidvid, Sneekit and others (though with Sneekit you purchase Sneeks, not bids!).
Look at the site. Everything seems legitimate, they are powered by various companies and backed by others.
The how to section apparently tells you everything you need to know about the company, and the sign up section they even tell you they are the “#1″ “Top rated penny auction site”.
Excellent news right? You’ve found the gold mine, so let’s get to it!
You go through an easy sign up section followed by what appears to be a bidding section on lower end products. The first thought might be “hey it’s a free “bid” so they aren’t going to give me that i-thingy that’s going on the front page!”. But if you stop for a moment and look around at all the highest bidders you will notice one particular indication that the legitimacy must be questioned, one bidder holds the leading bid on all the products…well…for a limited time! Well heck, maybe he’s just trying his luck on everything right?
Before you continue, wait for the timer to run down to zero on these “promotional auctions”, you will notice one thing…unless you bid, they wont! they will reach 1 second, halt there for a few moments and then all of a sudden they are boosted back up to 1 minute, or 1 minute 50 seconds with a new name as the lead bidder. Remember, it’s in the terms and conditions that unless the timer reaches zero, you don’t win!
Hint…it wont reach zero! Therefore this is no auction.
Simply this is an “offers” page made to look like one of these penny auctions.
Why? Because you’re guaranteed to win something! Then you’ll be so happy you’ll purchase bids to get other products with the “I’ve already won once, I can do it again!” mindset.
So carry on and place your bid, but wait on the next page! Click through the Congratulations section! (don’t worry, I wont lead you into the trap! We’ll stop before we get there!).
Now we’ve all seen this page before, it’s a standard payment page that you would see on any e-commerce site.
Normally at this point you would simply put in your details, there can’t be anything too risky in the Terms and Conditions right? There was nothing on that front page about any membership fee, or subscription charges!
If you stop for a moment and scroll down the page (presumably designed so that people who just want to get that amazing deal on a new phone or tablet will just click through without hesitation!) you will notice a little asterisk with the following:
“Included with this payment is a 7-day free Platinum membership. Once the free days expire, normal monthly fee of £ 59.99 applies. The membership is only binding for 3 months.”
This is where you should stop, but some don’t. This appears as if it is a standard payment gateway, so why wouldn’t you just make the payment?
Those who are aware of “pay monthly service” regulations might even have think the seven day free trial included with your purchase is the mandatory “seven working days beginning with the day after the day on which the consumer receives the goods” cooling off period set out in The Consumer Protection (Distance Selling) Regulations 2000. It’s not!
When asked why they do not adhere to The Consumer Protection (Distance Selling) Regulations 2000 our source at Ziinga stated that the law “does not apply to Ziinga”.
“Why?” you might think. Terms in the regulations that state purchases from auctions are exempt, but then we have already established this isn’t a purchase from an auction. This purchase has been through a promotional gift gateway deceivingly designed to look as if it is a standard penny auction.
Their intention was to deceive, therefore they are in the business of fraud.
I urge all persons who may be willing to trial this website to instead look around for a legitimate one. You cannot sign up and use the website for free, and Ziinga do not respect your right as a consumer to cancel your agreement with them, unless you want to pay their £28 cancellation fee.
Nowhere else on the website, bar one line in the terms and conditions state anything about the monthly membership, so their intention is clearly to hide this fact from a potential customer.
The customer service team (powered by Liveperson) will not help you, they will not give you any leeway, they will not respect your consumer rights. Liveperson declined to comment on these allegations.
By not offering sufficient information, and clearly advertising their membership fees they can be considered fraudsters by omission, law breakers by not following distance selling regulations, and a confidence company designed to deceive and make a quick penny at your expense.
If you have been scammed by Ziinga there are a number of ways to stop them, these are detailed here.
Before you do anything else, it is always worth contacting Ziinga directly. Although they will not help, your first step in getting out of any contract is to advise the organisation you are in contract with that you wish to “exercise your right to cancel under The Consumer Protection (Distance Selling) Regulations 2000″. It is also worth indicating that you were not made aware that these regulations were not applicable to Ziinga anywhere in the site, and that in accordance with these laws you cannot be held accountable for the lack of information provided.
If you get into any trouble, try mentioning the ASA (who have recently (29th February 2012) served Ziinga for misleading email promotions)
The next step is to delete any personal information they have off your account page. Go through the Liveperson chat and demand they remove all your payment details, though it probably wont get you anywhere, it’s always worth a shot!
Contact your bank and request a chargeback on the payments going to Ziinga of Flamingo Intervest, as they will not be sending you your product so don’t worry too much about it. (Unfortunately the website payment gateway is powered by Thawte, who although a legitimate company “verified by visa”, are being used in a illegitimate way. Therefore your bank may require you to fill out various forms in order to take full responsibility. No comment could be obtained from Thawte.)
The following step comes with a warning:
***As Ziinga are set up through a legitimate payment gateway, and the confidence scam is one of withholding information. If you do the following they may try to send debt collectors after you.
However they have signed you up to a credit agreement running any credit checks, and are therefore operating outside of FSA regulations. They don’t really have a leg to stand on, but it is my moral obligation to ensure you are aware of all possible outcomes! I don’t want a load of people coming to me saying “they’re taking this that and the other and it’s your fault”. This is just advice based on my experience***
The reason I gave you this warning is because the next step is to cancel your card, either through the lost, stolen or broken department at you bank.
Your bank should be willing to help you. Their job is to look after your money, so if they are not willing to do this, attempt to close the account so that you can open a new one elsewhere. – This is an extreme measure, but it might prompt them to be more helpful.

Below is the answer to a couple of questions posed to Brian Mertz of Nio. Inc.
1. New members are signed up to a 3 month binding contract and yet no eligibility check is undertaken to ensure customers are able to afford these payments, moreover customers are not given a cooling off period in accordance with distance selling regulations.
“Unfortunately we do not have the means to check if the user can afford the membership but since the membership was accepted by the user we can only assume that the user can afford the membership, otherwise the user can always cancel the membership by paying the cancellation fee. We don’t have a cooling off period, since the user is buying a online service – not a distant product. We also expect that people with a credit card can take care of them self and are more than 18 years old.”
2. Why is there no other information, save for a few lines in the terms and conditions, that clearly advertise a paid subscription?
“That is not correct. The subscription terms and prices are mentioned on:
- The payment page (where you enter your credit card details)
- The email receipt we send to the customer for confirmation after the purchase
- Under “your account” at the login area
- And in our terms & conditions that you accept when making a purchase”

I signed up for this on 19 april, paid 35 pounds for some bids, and the confirmation email alerted me to the fact that I had just subscribed for 59.99 per month for three months. I googled them and worked out it was a scam. I promptly called the bank and cancelled my card. I have not heard anything else from zinga until today (15 May), which is a letter which appears to be from intrum justitia to “secure immediate settlement of the outstanding amount of GBP 179.97″ and details of how to pay.
Where do I stand on this? I plan on ignoring it.

The best thing to do initially is contact Ziinga directly. If you haven’t used the service since the 19th April, they won’t be able to say that you’re being billed for a service you have used (unless you’ve used it! of course!).
Don’t contact Intrum Justitia yet, as from what I understand about debt collectors, any acknowledgement of the debt would result in action from them.
Hold out on paying, It’s not going to harm your credit history as they haven,t conducted any credit checks.
My advice would be to hound Ziinga until they give in and wipe the debt.
If you want I can send you Brian Mertz email address, and you could contact him directly. He is the CEO of Nio Inc. (the company responsible for Ziinga) and the person most likely to be able to help you, all the customer service reps will simply tell you “it’s policy” and end the conversation.
Hope you get this sorted soon.

Was interesting to read your article above & I have signed the petition!! I have been well & truly scammed by these people & at first felt like it was my own stupid fault but I am quickly realising that I am one of very many people who have been ripped off by this company ….. I thought Iwas the winning bidder for a camera & paid for the item straight away ….. A few days later I checked the status of the the shipping as the had taken the payment but they required me to verify my identity before they could ship it strange considering they could take payment without verifying anything!!! I was then charged 59.99 for my membership??!! A membership that I didn’t realise I had signed up for nor did I want!! Over a month ago I submitted a request to cancel this membership & was given a cancellation date I also spoke to someone on the live chat & told them I was not aware of this membership fee & I had cancelled it & told them not to take anymore money from my account & as i have found out today this was taken as my refusal to pay the membership fee & they did not process my request to cancel!! So again this month I have been charged 59.99 so I got on the live chat again to ask why they are still doing this when I had cancelled the membership & was sent a cancellation email & immediately they had taken another 28.00 from my account (the cancellation fee) I phoned them to demand my money back for the membership & complained about the fact that they cannot ship an item that I have paid for without verifying my ID but can take over £150 from my bank account …… I shouted at the woman over the phone & am ashamed to say I swore at her too!! But she assured me that no more money will be taken from my account & I also asked her to remove all of my details from their systems & she advised me to reply to the cancellation email & ask them to do it & she also tried to tell me that I didn’t try to cancel my membership over a month ago …… I’m just so gutted by this whole thing I have cried all day & just don’t know if there is any way I can get some of my money back …… Do you have any advice for me at all??

Yep it is a familiar story. I did what Matt said in the article (before I read it) and cancelled within 10 minutes of reading the ternms and conditions being emailed back to me. I still fail to see why they are not ruled by a cooling off period, they operate in UK with a Union flag logo and charge in sterling. They also do not comply with providing a UK address (my understanding). I did cancel my card, they waited till the last day of the appeal to reapply the £59.99 charge. Prior to this I was snet a letter from their fraud team in Malta saying if I didn’t pay up – over £150 – the debt collectors were coming and I would be sued for fraud.
I’d appreciate any advice on handling debt collectors and on handloing court actions.
A momentary lapse in a lifetime of cynicism.

Hi Gerry,
I’m sorry to hear you’ve had a problem with Ziinga too! I cannot fathom why they think they can get away with underhand conning tactics such as these!
When I asked the CEO he gave me a lot of run excuses, saying things like they don’t do credit checks because they “don’t have the facilities”, and don’t offer a cooling off period because they don’t think they are a distance selling service!
I’m not entirely sure what to suggest, though to be honest I think any court that was shown the case would laugh it out of the room!
If you do have any gripes about the company, here is the CEO of Nio inc. (Brian Mertz) email address! I probably shouldn’t give this out, but let’s be honest…they shouldn’t be conning people!

Thanks Matt. What I’m unsure about is how the debt collectors work – as far as I know they should have a court order but I don’t know details. I will email the CEO and will do a little poking in their corporate records to find out who shareholders are and start badgering them too. I’ll keep you updated. Also alert the Ziinga Sucks page on Facebook as I have done.
