买家说原来屋顶做的有问题导致漏水,根据的是他roofer的报告,但我查实他的roofer没牌照。验房时他的验房师讲屋顶没通风,会导致漏水(报告就这样写)。我也要求我原先的卖家作为被告到场。 我的问题是我声明屋顶99做,但没发票。我只是听说。而且现在买家换的是完全不同的屋 顶,更贵。现在的买家已卖房,每损失,赚了不少。请教庭上的应对攻防。

Thank you for your helping. I'm the seller. The point is this guy did inspection before he bought the property. His inspector warned him in the report " No ventilation will cause roof structure deterioration and roof leaking.... blister noted...Roofer is recommended to evaluate the roof against roof leaking." But this guy said the roof leaking caused by roof installed improperly based on his roof report. We have evidence his roofer has no license. We declared that the roof was made in 1999, but we have no receipt to prove it. We bought the property from Mr. Yvon. he was askd to present in the court as defender.

去年五月,我们的房子在门口插牌一周的时间就很抢手地卖出去了。既没有经纪,也没打广告,而且是在买家竞争自动抬价,超出我们报出的价格成交的。正当我们得意洋洋,心满意足的时候,一封最后通牒式的信件寄到我们手中。这是小额法庭起诉前的必经程序,法语叫 la mise en demeure 。这封挂号信会正式地通知你,何事何故要向你索赔多少钱(要列出具体金额)。限期十天,否则将在不另行通知的情况下采取法律行动。这无异于晴天霹雳,打得我们晕头转向。我们那么抢手,精致的房子怎么会有什么隐患?据信上说是壁炉的烟囱有问题。我立即给对方去了电话,对方没人接,在留言机上我脱口而出:`什么意思,你们是想敲诈勒索吗?` 对方没有回电,看样子铁了心地准备和我们上法庭了。我很快冷静下来,该面对的事情还是要面对的。我仔细研究了那封信,后附的检验报告及更换烟囱的发票,对方据此向我们索赔3500$。
